You Were Terminated. What Happens Next?

Termination cases are serious and highly fact-specific.

Immediate Steps:

  1. Contact the Union immediately.
  2. Do not contact management directly to argue your case.
  3. Preserve all documentation.
  4. Provide a full, honest timeline.

We evaluate:

  • Was there just cause?
  • Was progressive discipline followed (if applicable)?
  • Was there disparate treatment?
  • Was the investigation fair?
  • Were policies clearly communicated?
  • Are there mitigating factors?

Not all terminations can be overturned.

Cases most difficult to reverse often involve:

  • Policy violations with clear documentation
  • Dishonesty
  • Repeat violations after final warning
  • Safety-related misconduct
  • Intentional misuse of benefits

Cases that may be more defensible:

  • Procedural violations by management
  • Lack of progressive discipline
  • Inconsistent enforcement
  • Insufficient investigation
  • Strong mitigating evidence

If advanced, termination cases may proceed through appeal and potentially to arbitration under System Board procedures.

Arbitration is not automatic. It requires:

  • Legal merit
  • Contractual basis
  • Strategic review
