You Were Terminated. What Happens Next?
Termination cases are serious and highly fact-specific.
Immediate Steps:
- Contact the Union immediately.
- Do not contact management directly to argue your case.
- Preserve all documentation.
- Provide a full, honest timeline.
We evaluate:
- Was there just cause?
- Was progressive discipline followed (if applicable)?
- Was there disparate treatment?
- Was the investigation fair?
- Were policies clearly communicated?
- Are there mitigating factors?
Not all terminations can be overturned.
Cases most difficult to reverse often involve:
- Policy violations with clear documentation
- Dishonesty
- Repeat violations after final warning
- Safety-related misconduct
- Intentional misuse of benefits
Cases that may be more defensible:
- Procedural violations by management
- Lack of progressive discipline
- Inconsistent enforcement
- Insufficient investigation
- Strong mitigating evidence
If advanced, termination cases may proceed through appeal and potentially to arbitration under System Board procedures.
Arbitration is not automatic. It requires:
- Legal merit
- Contractual basis
- Strategic review
