- Did the Company follow proper procedure?
- Was due process provided?
- Was the discipline progressive?
- Is the level of discipline consistent with similar cases?
- Are there mitigating factors or extenuating circumstances?
- Is there evidence contradicting the allegation?
Under disciplinary grievance procedures, there are structured timelines for appeals and hearings. Missing deadlines can eliminate options.
Important Reality
Even when:
- You disagree
- You believe it is harsh
- You think someone else “got away with it”
If the Company:
- Followed the process
- Applied progressive discipline
- Has documentation
- Has precedent
- And there is no contract violation
