The questions we evaluate:

  1. Did the Company follow proper procedure?
  2. Was due process provided?
  3. Was the discipline progressive?
  4. Is the level of discipline consistent with similar cases?
  5. Are there mitigating factors or extenuating circumstances?
  6. Is there evidence contradicting the allegation?

Under disciplinary grievance procedures, there are structured timelines for appeals and hearings. Missing deadlines can eliminate options.

  • Followed the process
  • Applied progressive discipline
  • Has documentation
  • Has precedent
  • And there is no contract violation
